Why a Public
Judicial Inquiry of our Health System should be held
BASED ON EVIDENCE PRESENTED HERE

What
this is about
There are two documents that
are attached to this Brief. One is an
official letter (with name changes to protect privacy) from Toronto
Rehabilitation Institute Hospital, the largest Rehabilitation Hospital in
Canada, written by the Doctor who is the Medical Director of the Neurorehabilitation
Program. In this official letter The Toronto Rehab Institute and the doctor
detail the facts of the serious medical conditions of Patient Smith and details
the serious impact on that patients’ life over a number of years. To establish this medical profile took many
years that involved countless medical resources, hospitals, doctors, tests, professionals
and time and countless health tax dollars.
This official letter and the facts it represents and countless letters
like it are the reasons governments need more and more health tax dollars to
take care of the growing health needs of Ontarians. The government relies on
these facts from hospitals and doctors to assess where to cut back services
because of the growing cost of Health care.
Furthermore many depend on these official letters and the facts they
represent; Federal Government for CPP
Disability; The provincial government for ODESP payments; the City Government
for a host of Social Services; Insurance
companies for Insurance payouts for
injuries; Judges and courts take into
account and rely solely in many cases on these documents of victims such as
Patient Smith and make legal decisions
based on these documentations by doctors and hospitals affecting other people
and our financial and economic system.
The police rely on these documentations to establish the truth and
criminality of some of their cases. The
reliance on these types of health profiles about people like Patient Smith, by
hospitals and doctors, has its tentacles into every facet of our social fabric
and affects us all and is relied upon without question as an arbiter of truth.
The second document (names
and changes made to protect privacy) is a Notarized
Affidavit of documented investigations
conducted about the same Patient Smith over many years who is mentioned in the
official letter from Toronto Rehab Hospital and represents the medical profile
that took many years to build up. The
investigations show that the documentation by Toronto Rehab and the doctor are
fraudulent. They are not true. It is absolutely shocking to see this.
This Brief puts the Toronto Rehab
Institute official letter and its medical facts, fact by fact, beside the
corresponding facts of the Notarized
Affidavit documented investigations facts.
This Brief shines a powerful light on fraudulent activities that have
taken place over many years and affects us all. The Brief brings forward in the
same format systemically endemic events that reflect misdirected and misused
taxpayers health dollars compromising patient safety. This is why Child Protect Canada is asking
for a Public Judicial Inquiry.

throughout 2005, covering the same time the letter was written by Toronto
Rehabilitation Hospital.

1 Conclusion – The documented investigations of Patient Smith and
Partners business activities sheds a powerful light on the activities of the
Toronto Rehab, Dr. Mark Bayley and other health professionals and because it
takes place at the in same parallel time lines. Public Ontario taxpayers’ money
and medical resources and donors” money is used to create the medical profile for
Patient Smith.
2 Exhibit Evidence – The letter is addressed “To Whom It May Concern” Top
of the page
2 Exhibit B Evidence – Based on the notarized Affidavit of documented
evidence accumulated over a number of years this Health Profile of Patient
Smith Fraudulent documentation created by Toronto Rehab hospital is used to perpetrate
what fraud and with whom. “To whom..”
allowed this to be used in so many ways and has an unlimited destination with
unlimited time; Police! Courts! Insurance Fraud! How many Victims! What else!
2 Conclusion – The fraudulent referrals to doctors or for tests or
answers to certain health information or application for disability or O.D.S.P.
for example would be written specifically To Dr. So And So or to Mr. Or Ms. So
and so Re Patient Smith. When Toronto
Rehab Hospital and Dr. Bayley Acted on behalf Patient Smith by Writing to Whom
It May Concern Patient Smith and her Partners were given extraordinary ability
to use this fraudulent medical information to perpetrate unlimited crimes under
the guise of medical Privacy information.
The questions that must be answered are how this information to this
very day has been used and how to stop these criminal activities. Was the fraudulent information used with
maybe The Police! Companies! Courts!
Insurance Fraud! Who are the
Victims! How many are there! How is this used now and continues to be used!
How does the governments
putting all this fraudulent and criminal Medical Profiles information on
Patient Smiths and others’ Electronic Records entrench and perpetuate the
systemic and endemic crimes perpetrated in our health system, bleeding our
health system and compromising patient safety.

3 Conclusion – Here clearly everyone can see that both the Medical
Profile and this letter created by Toronto Rehab Hospital and the Notarized affidavit
refer to the same Patient Smith.

of the letter lines #1 and #2 where
it states, “ This letter is to confirm that Patient
Smith is
under my care for a brain injury.”

Investigation into Patient Smiths’ business activities is based on the
investigation conducted by Franco Investigation where Patient Smith is carrying
a large box to address…” On page
2 # 9 line 2 from the top at end of second line and line 3 where it states “…doesn’t carry Patient
Smiths’ line of (specifically manufactured products by Patient Smiths’
company)…” On page 2 # 9 line 6 and 7
“…products continue to be distributed in Canada solely by Patient
Smith…”. On page 2 # 10 lines 2, 3, 4 and 5 “...Patient Smith (has) private
individual clientele …in addition to Patient Smiths’ wholesale and Patient
Smiths’ products distribution business.”
4 Conclusion - The fraudulent letter from Toronto Rehabilitation
Hospital states “ This letter is to confirm that Patient Smith is under my
care for a brain injury” and
this letter is clearly used by Toronto Rehab Hospital to aid and abet and
participate in committing further crimes. “This letter is to confirm…” is
saying look we Toronto Rehab with our reputation and all the referrals and

meticulous testing and
doctors and professionals that dealt with Patient Smith and the documentation
we have built up over many years are behind Patient Smith and are true beyond
reproach or questioning.
The statement in Toronto Rehab letter “…
Patient Smith is under my care for a brain injury” is saying the Patient Smith
needs care and that is why is under my care because I know, Patient Smith is
under my supervision. Care also means I
see with my own eyes that Patient Smith needs care is very injured and needs my
constant attention and care. You can’t
argue with this kind of stuff. This
Doctor and Toronto Rehabilitation Hospital and the other professionals, doctors,
etc. involved with Patient Smith are telling you the truth and we are sure 1000%.
5 Exhibit A Evidence - The Toronto rehab Hospital in aiding and abetting
Patient Smith with the letter continue and state in the paragraph line 3,4 and the first word of line 5 “Because
of this Patient Smith is unable to work and is currently only receiving a disability
pension.”

5 Conclusion - Normally the people who have brain injuries are
victims of events and circumstance but here we see that Patient Smith is not
only not a victim but a cold calculating perpetrator who cunningly and
effectively uses the manufactured persona of victim to perpetrate unimaginable
crimes aided and abetted by business partners and Toronto Rehab Hospital using
Ontario Health Tax dollars and resources and time spent. It takes enormous amounts of medical
documentation which Toronto rehab and who else provided to get disability
pension This is not enough because this
fraudulent letter and perhaps
many actions by health professionals are designed to be a tool to get more,
much more. What?
“
Patient Smith is unable to work” statement means Toronto Rehab is
perpetrating lies and fraud. Toronto
Rehab states Patient Smith “…is currently only receiving disability pension.”
Meaning it is not enough to receive disability pension for such a victim as
Patient Smith and after all the years of Toronto Rehab Hospitals’ documentation
and involvement.

Notarized Affidavit and the all the evidence surrounding these investigation
are conclusive evidence that the letter from Toronto Rehab Institute is
fraudulent and for criminal purposes.
6 Conclusion -
“should you have any questions please do not hesitate to contact me” is an
attempt solely created to use the fraudulent information in a fraudulent letter
for the purpose of committing and using this info and letter to committing more
crimes. Perhaps creating more
victims! How many and who are the
victims! Were the police used! Was there insurance fraud! Were other
Hospitals and Doctors Used for the purposes of fraud using this fraudulent information! Were different health professionals used to
affect their attitudes towards some issues because Patient Smith is a big victim
based on a fraudulent health profile!
Were the courts used in such a fraud affecting outcomes of
different cases based this fraudulent
criminal information provided by Toronto Rehab Institute Hospital! Was this fraudulent criminal information put
into electronic health records of Ontarians for the purpose of perpetuating
further fraud and bleeding of the Ontario health system indefinitely! Were Patient Smiths business partners affected
by the use of this fraudulent information!

7 Exhibit B Evidence – In the Sworn Affidavit to the investigations
conducted and documented on page 2 bottom left is written SWORN before me at
the (next line) City of Toronto (next line) In the Province of Ontario (next
line) This (written in pen) 15th (typed) day of November 2005. Underneath this is the signature of the
Commissioner and underneath the signature is typed A Commissioner etc. Next to this on the right is the signature of
the person who did the investigation and swore to this information to be true
on the left again is the stamp Pat Batsoulls, Barrister and Solicitor, Notary
Public Commissioner of Oath in and for the Province of Ontario. My Commission
is of unlimited duration.

7 Conclusion - These are two
powerful and impressive signatures that say we are telling the truth and you
can rely on us and that it is a criminal offense to swear or give our names to
back up untrue or false information. Here the medical system is lying. The
Affidavit clearly tells the Truth as to what the facts are in the
Investigation. This shines a bright light on the massive hidden fraud that is
perpetrated against the people of Ontario.
There is a need for a
Judicial Public Inquiry that has the legal muscle to uncover enormous crime
that lies under the guise of Private medical Information. A public Judicial Inquiry as it uncovers fraud
will make public what can be made public and as it uncovers fraud keeps private
that which must be kept private to protect the innocent.

Premier McGuinty begins to receive from Prime Minister Paul Martin billions of
dollars for the Province of Ontario - The Health System through federal
transfers with the New Health Accord.

asking for an investigation and accountability- no answer.

17 Exhibit – Now in 2012 Ornge, not for profit emergency health
company who received $ 150 Million of Ontario Health Taxpayers money is being
investigated for enormous financial crimes by the OPP. Minister of Health Mathews says Ornge was
lying to her when she asked them if everything was okay in a meeting a year
ago. She sat across from the Chairman of
the BOARD OF Ornge who had a lot of political connections for many years to the
Liberal and conservative party and a lawyer former head of the the Ontario
Liberal Party who assured her that everything was fine. The Minister of Health for Ontario allegedly did not do due diligence in this matter. Many complaints and

of things wrong with Ornge throughout the years were treated without due
diligence and true accountability.
Why? It is public record that
Ornge hired many well-connected political insiders into the ranks of Ornge
Management. Did these political connections
and political acquaintances aid and abet the government in decisions that that
led to a lack of accountability and mismanagement of Ontario Tax payer’s health
dollars

18 Conclusion – 1 There
is a great public cynicism and lack trust in this government and elected
officials to bring transparency and accountability to our health taxpayer’s
dollars. 2 This cynicism and lack of
trust will grow stronger and even more pronounced as even more revelations are
coming forward from Ornge and child Protect Canada etc. 3 Yes this happened and is
happening under this liberal government watch but it could have just as easily
been any other government watch Conservative or NDP. 4 There is a great sense from the public that there is a feeling of
entitlement from politicians regarding public money and this sense of
entitlement is also rampant in people that work in the health system and for it
because it is public money. The
operating principle here is that people who feel entitlement and misspend
public health funds do not see it as their own money and therefore with no
strict management and transparency and accountability and serious consequences
continue to misspent public health dollars.
These same people would never treat their own money the same way. A head of a private company who invested his
own billions and that of his company in an ongoing project who was delivered
allegations and documentation of wrong doing and mismanagement of his money in
his company would not rely on a friends or acquaintance or political cronies
that everything was okay but in fact would investigate completely and thoroughly
doing the due diligence that would be expected, no less.

PROPOSAL TO THE LIBERAL GOVERNMENT, MR.
HUDAK AND MS. HORWATH
OBJECTIVES
1) To call for and set up a Judicial Public Inquiry into
the allegations brought forward here in order to clean up and make the health
system more accountable and more transparent
2) Appoint 3 judges to preside over the Inquiry to show
that Elected officials mean business and are very serious about bringing
accountability
3) Leaders of the 3 parties and two more from each party
health and justice for a total of 9 will lead and coordinate all aspects of
doing this inquiry and facilitating all the parts and players to bring them to
the table to make this happen. This
group of 9 three from each party will meet twice a week to make this
happen.
There will be minutes of the
meetings and a majority vote will pass all decisions.
This will give the public a
sense that their elected officials are serious about this and it will go along
way to change public cynicism.
This all-party approach will
send a strong message from the politicians that entitlement and the misuse of
public money will not be tolerated.
4) We are asking these 9 members of all the parties to
hire Child Protect Canada, which has made this proposal and brought forward
these issues regarding the health system and the need to clean it up. Hiring Child Protect Canada will be a strong
early symbol that will show that you look like you are doing something
about this. By Hiring Child protect
Canada, which brought this to yours and the publics’ attention you are saying
we will do whatever it takes even if it is uncomfortable.
Upon Being hired Child
Protect Canada and its team of professionals will provide a draft for the approval
of the nine member political board mapping out the role to be played by Child
Protect in working for and aiding the nine member board for this important and
challenging work.
You are showing you are not afraid
to do what is necessary and you will make the necessary changes in spite of how
hard it is.
5) Part of the job of Child Protect Canada other than
helping to facilitate this process of cleaning the Health System up in Ontario
would be to help be a catalyst for setting up with the 9 member group regular
public information sessions about what is going on with the process of the
inquiry
These regular public
information sessions will be very important to change the Ontario public
cynical attitude about their elected representatives.
You will all gain a lot of
political points in Ontario and Canada and beyond for this out of the box
approach.
